The New York Estate Tax Cliff: A Small Change Can Matter

An estate can be below the federal exclusion and still need a New York estate-tax review. The state’s credit phaseout also means that a small change in the taxable estate can have a much larger effect than a simple tax-on-the-excess estimate suggests.

Know which threshold you are comparing

For deaths in 2026, New York’s basic exclusion amount is $7,350,000. Resident filing requirements generally compare the federal gross estate plus includible gifts with that amount. A taxable-estate calculation then accounts for the deductions and adjustments that actually apply.

The credit phases out above the exclusion and disappears when the New York taxable estate exceeds 105% of it. The 2026 arithmetic is $7,350,000 × 1.05 = $7,717,500. That is a phaseout reference, not a substitute for Form ET-706 or a calculation of the tax due.

Use a range, not a single optimistic value

Suppose a household’s initial asset inventory totals $7.2 million. An omitted ownership interest or a higher property valuation could move the estimate across the filing line. The right next step is to improve the inventory and review the rules—not assume the first total settles the issue.

Put low, central, and high values beside assets that lack a recent valuation. Keep ownership, beneficiary designations, and any life-insurance inclusion questions in the same working file for the attorney and CPA.

Do not confuse wealth with cash available

A business or property may contribute to estate value without providing cash on the date the estate needs it. Map the possible tax bill, debts, administration costs, and family distributions against the assets that could actually fund them.

Bring the right questions to the attorney

Ask what is included, which gifts may be added back, what deductions apply, and how the plan behaves if values rise. If charitable provisions or ownership changes are discussed, have the attorney explain their consequences for the family as well as the tax result.
